aria-labelledby=\"elementor-tab-title-1791\"><p class=\"photoswipe-wrapper\" align=\"justify\">On March 6, 2013 Law 6400\/2013 was published in the Official Gazette of Rio de Janeiro.\u00a0<strong>Law N\u00ba 6400\/2013<\/strong>It determines the\u00a0<strong>periodic self inspection to be carried out<\/strong>to be carried out by the condominiums or by the owners of the residential, commercial and public buildings, in public buildings, including structures, facades, gable, marquises, roofs and hillside containment works as well as all its installations and\u00a0<strong>creates a Technical Report of Building Inspection (LTVP)<\/strong>\u00a0in the state of Rio de Janeiro and makes other arrangements.<\/p><p align=\"justify\">The self inspection is mandatory for buildings of three or more floors and for those with a built area of 1000m\u00b2 (one thousand square meters) or more, regardless of the number of floors, and on all facades of any building that has a marquee or balcony projected over the public sidewalk.<\/p><p align=\"justify\">According to Law No. 6400\/2013, the following are considered responsible for the building, as the case may be: the owner; the condominium; the administrator, in cases of public buildings (Art. 1, \u00a7 1, III). In the case of the condominium, the landlord is responsible as its legal representative.<\/p><p align=\"justify\">Still according to the law in question,\u00a0<strong>it is the responsibility of the liquidator:<\/strong>:<\/p><ul><li>To summon the general assembly to give notice of the content of the report after its issuance (Art. 1, \u00a7 3, IV);<\/li><li>Provide the preventive or corrective building maintenance proposed in the LTVP (Art. 1, \u00a7 3, V and VI);<\/li><li>File the LTVP in the condominium and display it to the authority when requested (Art. 1, \u00a7 4, caput);<\/li><li>Up to fifteen days before the end of his mandate or annually, if the duration of the mandate is greater than one year, convene a general assembly to communicate the report (Art. 2, sole paragraph).<\/li><li>Execute the measures indicated in the LTVP (new syndicate), except for those that cannot be postponed, which will be the responsibility of the liquidator in management (Art. 4, sole paragraph).<\/li><\/ul><p align=\"justify\">It is well defined in Art. 5 that the\u00a0<em>\"responsibility for the security of the buildings and their facilities is of the condominium or the owner of the building, except the provisions of Art. 618 of the Civil Code\".<\/em>.<\/p><p align=\"justify\">In the event of non-compliance with the provisions of this Law,\u00a0<strong>, the landlord shall be personally liable,<\/strong>jointly and severally with the condominium, for damage that the lack of repairs or maintenance of the building may cause to residents or third parties, unless the non-compliance is due to deliberation at a meeting.<\/p><p align=\"justify\">The survey will be conducted by a Civil Engineer legally qualified at CREA\/RJ and its author will be responsible for preparing the LTVP. The LTVP will be accompanied by the Technical Responsibility Notation - ART, with the CREA\/RJ, as legally determined.<\/p><p align=\"justify\">The survey must be accompanied by the union member, sub union member or member of the Council.<\/p><div><p align=\"justify\">The<strong>\u00a0Complementary Law No. 126,<\/strong>\u00a0of March 26, 2013, establishes the obligation to conduct technical surveys on existing buildings in the City of Rio de Janeiro and makes other provisions. This Complementary Law establishes that, if\u00a0<strong>the survey is not carried out, the person responsible for the property will be charged a monthly renewable fine<\/strong>corresponding to five VR - Residential Standard Unit Value or five VC - Non Residential Standard Unit Value, established for the property, as the case may be, for the purpose of calculating the Urban-IPTU Property Tax, in the following infractions.<\/p><p align=\"justify\">As an example, below is the value of the fine for residential buildings in some areas of the city.<\/p><p align=\"justify\">Avenida Ataulfo de Paiva - VR = R$ 2,835.34 \/ Monthly Fine = R$ 14,176.70<br \/>Avenida Borges de Medeiros (height Lagoa)- VR = R$ 3,513.51 \/ Monthly Fine = R$ 17.567,55<br \/>Avenida Vieira Souto - VR = R$ 4.998,87 \/ Monthly Fine = R$ 24.994,35<br \/>Avenida Delfim Moreira - VR = R$ 5.141,71 \/ Monthly Fine = R$ 25.708,55<\/p><\/div><p align=\"justify\">CPR not only offers you the best service for LTVP preparation and delivery. In the State of Rio de Janeiro, it is established the obligation of a decennial self inspection by the condominiums or owners of residential and commercial buildings, and by the governments of the State and municipalities, in public buildings, including structures, basements, fa\u00e7ades, frames, gable roofs, marquises and roofs, and in their electric and hydraulic installations, sanitary, electromechanical, gas and fire prevention and escape works and hillside containment, with less than 25 (twenty-five) years of useful life, from the \"habitation\", by professionals or companies qualified at the respective Regional Council of Engineering, and Agronomy - CREA or by the Council of Architecture and Urbanism of Rio de Janeiro - CAU\/RJ.<\/li><\/ul><p align=\"justify\">\u00a0\u00a7 1 Condominiums or owners of commercial and residential buildings referred to in the caput of Article 1 with more than twenty-five (25) years of useful life have the obligation to carry out five-year self-inspections.<\/p><p align=\"justify\">I - The fallen or preserved buildings are not subject to the obligation established in the caput, being its inspection in charge of the municipal public body responsible for the supervision of stability and safety of buildings.<\/p><p align=\"justify\">II - Single-family residential buildings are excluded from the obligation to carry out self-monitoring.<\/p><p align=\"justify\">III - The owner is considered responsible for the building, as the case may be: the owner; the condominium; the administrator, in cases of public buildings.<\/p><p align=\"justify\">\u00a0\u00a7 Paragraph 2 The condominiums before the building completes five years of completion of the work, in the fourth year, shall require from the developer, builder or contractor, an inspection report, under the terms of Article 618 of the Civil Code.<\/p><p align=\"justify\">\u00a0\u00a7 3\u00ba The inspection defined in the caput shall be carried out by an engineer or architect or company legally qualified in the Professional Councils, CREA\/RJ and\/or CAU\/RJ, at the expense of the condominium or building owner, and its author shall be responsible for the respective report.<\/p><p align=\"justify\">I - The professional will issue the respective technical report, accompanied by the Technical Responsibility Notation - ART, with the CREA\/RJ, in the case of engineers; and Registration of Technical Responsibility - RRT with the CAU\/RJ, in the case of architects.<\/p><p align=\"justify\">II - The report will contain the identification of the property and its responsible, the methodology used, the information on anomalies, their characteristics and probable causes, the period within which the conditions of safety and stability will be guaranteed and, if applicable, the necessary repair or preventive measures.<\/p><p align=\"justify\">III - At any time from the beginning of the survey, being verified the existence of an immediate or imminent risk for the public, the responsible professional shall immediately inform the competent municipal body, so that arrangements can be made for the isolation of the place, when applicable, within twenty-four hours, informing the person in charge of the building in writing.<\/p><p align=\"justify\">IV - Once the report has been issued, the person in charge of the building shall convene a general meeting to inform of its contents.<\/p><p align=\"justify\">V - In compliance with article 1341 of the Civil Code, the condominium will provide the preventive building maintenance proposed in the report, developed under the responsibility of a qualified architect\/engineer.<\/p><p align=\"justify\">VI - The condominium will provide the preventive or corrective building maintenance, proposed in the report, developed under the responsibility of a qualified architect\/engineer referred to in Article 1.<\/p><p align=\"justify\">\u00a0\u00a7 4 The report referred to in the previous paragraph shall be filed at the condominium, under the responsibility of the landlord or owner of the property, and displayed to the authority when requested.<\/p><p align=\"justify\">\u00a0\u00a7 5\u00ba Self inspection is mandatory for buildings of three or more floors and for those with a built area of 1000m\u00b2 (one thousand square meters) or more, regardless of the number of floors, and on all facades of any building that has a marquee or balcony projected over the public sidewalk.<\/p><p align=\"justify\">\u00a0\u00a7 6 Upon completion of the works and building installations, the developers, builders and contractors are obliged to deliver, preferably in magnetic or paper medium, the structure plans (foundation, pillars, beams, slabs and marquises), with their respective load plans, as well as installation projects, containing the name and registration number of the Regional Council of Engineering, Agronomy - CREA\/RJ or the Council of Architecture and Urbanism of Rio de Janeiro - CAU\/RJ, the professionals responsible, all as built, for the city hall, in the territory where the building is located, and the condominium of residential and commercial buildings or the owner of the building.<\/p><p align=\"justify\">\u00a0\u00a7 7 All building works, to be built, or the reform of existing buildings, which involve the addition or demolition of masonry or structures, including the opening of windows, mainly gable, shall be subject to technical monitoring by engineers or architects, promoting the Technical Responsibility Notes (ART), with the Regional Council of Engineering and Agronomy - CREA, or through the Register of Technical Responsibility - RRT, when dealing with the Council of Architecture and Urbanism of Rio de Janeiro - CAU \/ RJ.<\/p><ul><li>Art. 2. Up to fifteen days before the end of his mandate or annually, if the duration of the mandate is greater than one year, the trustee shall convene a general assembly to communicate the report.<\/li><li>Art. 3. The City Halls will prepare the model of the Technical Report of Building Inspection (LTVT), which should be brief, accurate and easy to complete and read, including the item \"arrangements\", in which the liquidator will indicate the initiatives to be taken for the security of the building and facilities, as recommended in the report.<\/li><li>Art. 4. The receiver appointed for a new exercise shall be obliged to carry out the measures indicated in Article 3, except for those that cannot be postponed, which shall fall to the receiver in management.<\/li><li>Art. 5. The responsibility for the security of the buildings and their facilities lies with the condominium or the owner of the building, except as provided in Article 618 of the Civil Code.<\/li><\/ul><p align=\"justify\">\u00a0Single paragraph. In relation to the safety of buildings and their facilities, the City Hall is responsible, through the Organic Law, Master Plan and Complementary Legislation, such as the Building Code, Licensing, etc:<\/p><p align=\"justify\">I - to request, on an annual basis, by sampling, initially considering the oldest, from building superintendents and owners, the Technical Reports of Building Surveys (LTVP) executed, and whether the building recovery measures and their facilities have been taken.<\/p><p align=\"justify\">II - apply penalties where appropriate.<\/p><p align=\"justify\">III - to file criminal proceedings against the offenders, in the cases provided for in Art. 1, \u00a7 5.<\/p><ul><li>Art. 6. The City Halls should guide the condominiums that, independent of the Technical Report of Building Inspection (LTVP), make the preventive building maintenance, involving structure, subsoil, marquee, facades, frames, gable and roofs, electrical, hydraulic and sanitary installations, electromechanical installations, gas installations and fire and exhaust prevention and hillside containment works.<\/li><li>Art. 7. In the event of non-compliance with the provisions of this Law, the liquidator shall be personally liable, jointly and severally with the condominium, for damages that the lack of repairs or maintenance of the building may cause to the residents or third parties, unless the non-compliance is due to deliberation at the Assembly.<\/li><li>Art. 8. The Executive Branch shall regulate this Law, after consulting the Regional Council of Engineering and Agronomy of the State of Rio de Janeiro - CREA-RJ and the Architecture and Urbanism Council of Rio de Janeiro - CAU-RJ, in the shortest term possible.<\/li><li>Art. 9.
